Terms of Service

1. Acceptance

By creating a Spark account or using Spark, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility

You must be at least 13 years old to use Spark. If you are under 18, a parent or guardian must accept these Terms on your behalf.

3. Your account

You are responsible for keeping your login credentials private and for activity under your account. Notify us at legal@spark-rm.com if you suspect unauthorized access.

4. Acceptable use

See the Acceptable Use Policy. In short: do not use Spark to harass people, automate bulk outreach, misuse contacts, reverse-engineer the app, violate law, or use outputs to train competing AI systems.

5. Your content

You retain ownership of the content you put into Spark, including contacts, notes, reminders, uploads, drafts, transcripts, and conversations. You grant Spark a limited license to process that content to provide, secure, support, and improve the service, including sending task-relevant content to our processors for hosting, inference, diagnostics, notifications, subscriptions, and support.

Spark does not sell your content, and our AI processor agreements prohibit model training on your data.

6. AI features

Spark drafts messages and surfaces suggestions using AI. AI outputs may be inaccurate, incomplete, or off-base. You are responsible for reviewing anything Spark writes before sending it. Spark does not send outreach automatically.

7. Subscriptions

Paid subscriptions are subject to the Subscription Terms and Refund Policy. Subscription benefits, prices, and limits are shown in the app or at purchase and may vary by platform or region.

8. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, the Acceptable Use Policy, or applicable law. We will give reasonable notice when possible.

9. Disclaimers

Spark is provided "as is" without warranties of any kind. We do not guarantee uptime, accuracy of AI outputs, delivery of third-party notifications, or that any feature will continue to exist.

10. Limitation of liability

To the maximum extent allowed by law, Spark's total liability is limited to the amount you paid us in the 12 months before the claim arose.

11. Indemnification

You agree to indemnify Spark against claims arising from your misuse of the service, your violation of these Terms, or content you provided.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, unless your local consumer law requires otherwise. Before filing a formal claim, you agree to email legal@spark-rm.com so we can try to resolve the issue informally.

13. Changes

We may update these Terms. Material changes prompt re-acceptance the next time you open Spark. See the legal changelog.
