This EULA governs your use of the Spark mobile application.
1. Grant of license
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Spark on devices you own or control, solely for your personal, non-commercial use, in accordance with the Terms of Service and Acceptable Use Policy.
2. Restrictions
You may not:
- Copy, modify, or distribute the app except as permitted by the app store.
- Reverse-engineer, decompile, or extract source code except where law permits.
- Use Spark to build a competing product or service.
- Use Spark outputs to train AI models.
- Rent, lease, sell, or sublicense the app.
3. Ownership
Spark and its licensors retain all right, title, and interest in the app, including all intellectual property rights. You retain ownership of your content.
4. App Store terms
This EULA is between you and Spark, not Apple. Apple has no obligation to provide maintenance or support for Spark. Apple is a third-party beneficiary of this EULA and may enforce it against you. If Spark later becomes available through Google Play, Google's terms will also apply to Android downloads.
5. Termination
This license terminates automatically if you breach these terms. On termination, you must stop using and delete the app.
6. Governing law
This EULA is governed by the laws of the State of Delaware, excluding conflict-of-law rules, unless your local consumer law requires otherwise.
